Marco Rubio has demonstrated an evolving stance regarding the automatic granting of citizenship based on place of birth within the United States. During his 2016 presidential campaign, he was involved in filing a court brief that defended the long-standing interpretation of the Fourteenth Amendment as conferring citizenship upon nearly all individuals born on American soil, regardless of parental immigration status. This legal filing was made in the context of a challenge to his own eligibility for the presidency based on his parents' non-citizen status at the time of his birth in Miami. However, at a later date, the Florida senator publicly signaled alignment with a hard line on the issue, particularly in response to proposals to end the practice.

This shift in position is notable given that Rubio himself is a beneficiary of the existing birthright citizenship principle, as his parents had not yet been naturalized when he was born in 1971.
